Promotions Rules

• General  

1. 1. These Promotion Rules (the “Promotion Rules”) are provided to you to explain the rules of entry and participation in any and all of the competitions which GenieNexus (Company Number 15371149, having its registered address at 91 Waterloo Road, London, UK) (hereinafter, the “Promoter”, “Us”, “Our” or “We”) will list on its website at: genienexus.com (the “Website”) from time to time.
   2. We may choose to list, at are sole discretion, standard competitions (hereinafter “Standard Competitions”) or “instant win” competitions (hereinafter “Instant Win Competitions”, and together with the “Standard Competitions”, the “Competitions”) and might list other types of competitions at our discretion and subject to the provisions of applicable laws and regulations.
   3. In the event of any conflict between the Promotion Rules and any other content posted on the Website from time to time and/or provided to you, including with respect to any specific Competition or in general, the Promotion Rules shall govern.
   4. The Promotion Rules incorporates by reference also the Terms of Use for our Website (at: genienexus.com/terms-conditions) and our Privacy Policy (at: genienexus.com/privacy-policy) and by accepting the Promotion Rules you also agree to be bound by the above. Any breach of any of the above agreements shall constitute also a breach of the Promotion Rules.
   5. We reserve our right to amend the Promotion Rules from time to time at our sole discretion. The latest version of the Promotion Rules will be posted on the Website, and you are expected to review the Promotion Rules from time to time and especially prior to entering any Competitions in order to make sure that you are familiar with the most updated version.
   6. We reserve the right to cancel, suspend or amend any Competitions where it becomes necessary to do so for circumstances out of our control or in any other circumstances subject to applicable laws. In such circumstances only, we may refund any entry fees you have paid subject to procedures to be published on the Website and to applicable laws.
   7. Please note that the Competitions are in no way sponsored, endorsed, administered by or associated with any third party whatsoever, including without limitations, by GenieNexus. By entering any Competitions, you hereby agree that GenieNexus has no liability and is not responsible for the administration or promotion of the Competitions on the Website.

• Publications

1. 1. You agree that we may use your name, image and address to announce the winner of any Competitions. You further agree to participate in any reasonable publicity required by us from time to time.
   2. If you are a winner and you do not wish to participate in any publicity, you must notify us prior to the Closing Date via email at: info@genienexus.com. If you do not agree to participate in any publicity about the Competition, we may still provide your details to the Advertising Standards Authority if this is our obligation to do so. 

 

• Eligibility to Enter a Promotion

1. The competition is open to all residents in the UK and the Republic of Ireland aged 18 years or over, except for: (i) all employees of the Promoter who have been employed with the Promoter during the preceding 12 months from the start date of the applicable Competition, (ii) agents or suppliers of the Promoter, who are professionally connected with the competition or its administration, and who have been engaged with the Promoter during the preceding 12 months from the start date of the applicable Competition, or (iii) members of the immediate families of either (a) and (b) above.
2. By entering the Competition, you confirm that you are eligible to do so and that you are eligible to claim any prize you may win in such Competition, including that you are above 18 years of age. 
3. The Promoter may require you to provide proof that you are eligible to enter the Competition and to claim the relevant prize by asking you to provide more information or documents (including without limitations, a government issued identification documents with a picture). If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the Competition at the Promoter’s sole discretion.
4. The Promoter will not accept Competition entries which are: (i) automatically generated by a computer or through any other means, or (ii) false or incomplete.
5. No refunds of the entry fee will be given in any event, including: (i) if, following your entry into the Competition, you or the Promoter subsequently find out that you are not eligible to enter the Competition or to claim the applicable prize, (ii) if, following your entry into the Competition the eligibility criteria changes and you are no longer eligible, (iii) if you are disqualified from the Competition by the Promoter for any reason, or (iv) if you withdraw from any Competition, close your account with us, cannot be reached in order to accept a prize, etc.
6. In addition, if you engage in any form of fraud, any illegal or objectionable activity, any breach of the Promotion Rules, the Terms or our Privacy Policy or any other activity or behavior which, at the Promoter’s sole discretion, might cause disturbance or interruption or damage to the Promoter, the Website, the Competition or any other users, then, at the Promoter’s sole discretion, all of your entries will be deemed void and no refund will be provided. In addition, the Promoter may, at its discretion, refuse to allow you to enter any future Competition and/or to use any other services on the Website. 
7. Anything to the contrary above notwithstanding, you may request a refund up to 24 hours before any Competition and such request shall be approved by the Promoter except that the Promoter shall be entitled to refuse any request for refund for reasonable reasons, including without limitations, if you have breached any of the terms and conditions hereunder (or in any other terms or policies of the Promoter), if a refund would cause the Promoter not to be in compliance with any applicable laws and regulations or otherwise. Requests for a refund during the last 24 hours before any Competition shall be denied.

 

 

• Entering a Competition

1. In order to enter any Competition on the Website, you must answer correctly a question presented to you or solve another type of challenge, at the Promoter’s sole discretion. The type and level of the challenges, including the questions and the format of the above might change between Competition to Competition and/or between one user to another. 
2. Unless specifically set forth otherwise, all entries to Competitions must be received by the Promoter by no later than the time specified on the Website for the applicable Competition as the Closing Date of such Competition. Entries received after the applicable Closing Date will be automatically rejected and disqualified and no refunds will be given to the entrants. You hereby agree that you shall not have any claims towards us in this respect.
3. A Competition may have a maximum number of allowed entries at the Promoter’s sole discretion. However, there is no minimum number of entries, and the Promoter will not hold void, suspend, cancel, extend the Closing Date or amend the applicable Competition due to a lack of entries. 
4. Upon purchasing an entry (paid entry), we will normally send you a confirmation for your entry via the contact details you provided to us or through your personal area on the Website. However, please check your registration independently in order to make sure you are registered to the required Competition. Failure to send you the above confirmation does not mean you are not registered to the applicable Competition. 
5. All entries must be completed as required from time to time by the Promoters and all information must be accurate and updated. We will not be liable for entries which are not completed, lost or delayed regardless of the reason for the above. 
6. In order to enter any Competition, you may use either a paid entry or a free entry. Free entries may be made through the process set forth below in the “Free Entry” part of the Promotion Rules.

 

• Free Entry

1. You may use the “free entry” option to enter any Competition by sending your free entry by pre-paid first or second-class post to the Promoter at the following address: 91 Waterloo Road, London, UK. Please note that hand delivered entries will not be accepted to the Competition.

1. You should also include with your entry the following information: (i) the details of the Competition you wish to enter (such as name, number, etc.), (ii) your full name (as shown in your passport or other identifying governmental issued document), (iii) your date of birth, (iv) your address and contact details, including mobile phone and a valid email address, (v), and (vi) your answer to any question or challenge associated with the applicable Competition.
2. You may make multiple free entries for any Competition up to any maximum number of entries set by the Promoter. Please note, however, that each free entry must be submitted and posted to us separately. Multiple entries in one envelope or on one postcard will not be accepted as multiple entries and may be counted as one single entry or rejected and disqualified altogether at our sole discretion.
3. All entries into Standard Competitions must be received by us prior to the Closing Date for the applicable Competitions and prior to all tickets in such Competitions being allocated. Free entries which will be received within 48 hours of the Closing Date and/or the date on which all tickets have been sold/allocated will not be entered into the selected Competition but will at the Promoter’s discretion be entered into the next Competition of a similar value for which entries remain available. Free entries which are otherwise received after the Closing Date and/or the date on which all tickets have been sold/allocated will not otherwise be entered into the selected Competition or any other Competition. Please note that proof of posting does not guarantee that you will be entered into the Competition and will not be accepted as proof of receipt.
4. Any free entries into a Instant Win Competition must be received before all tickets have been sold/allocated or, if not all tickets are sold/allocated, within forty eight hours (48 hours) after the Closing Date for the applicable Competitions in order to be entered into the Instant Win Competition. If the number of entries received reaches any cap or limit before your free entry is received, you will not be entered into the Competition or any other Competition.
5. In order to use the free entry option to enter any Competitions, you must register on the Website and create an account.

 

1. Winners

1. For Standard Competitions, all users who correctly answer the Competition’s questions or challenges will be placed into the Competition and a participant will be chosen by random draw to be eligible to receive the applicable prize for such Competition. The random draw will take place as soon as reasonably possible and, in any event, unless other set forth in the Website for such Competition, within seven (7) days of the Closing Date (hereinafter, the “Draw Date“).
2. All participants in any Competitions will have their names published on the Website and may be viewed by all users during the live draw in the Competition or otherwise. If you do not wish to have your name posted as aforesaid, you must contact us at: info@genienexus.com as soon as reasonably possible after you have completed your entry and, in any event, at least 48 hours before the live draw takes place however please note that we must still provide the information to the Advertising Standards Authority on request.
3. The prizes in any Instant Win Competition will be allocated at random to numbers in a list of participants. Each entry into such Instant Win Competition which correctly answers the Competition’s applicable question or challenge will be randomly allocated a number to participate in the draw. If the number matches a prize, then the applicable participant will win that prize.
4. Eligible Free entries to Instant Win Competitions, will be randomly allocated a number on receipt by the Promoter. The Promoter will notify the participant if they won by an automated email sent to the contact email address that the participant provided with its entry. The email will be sent automatically as soon as the participant’s number is identified as a prize winner. Unsuccessful participants via the free entry option will not be notified by the Promoter.
5. We will either publish or make available information that indicates that a valid award has taken place. We will publish the applicable names and/or numbers of the winners on the Website and send such information to the participants.
6. All winnings and draws are final and cannot be appealed. Please note that no correspondence or discussion will be entered into with participants who wish to appeal or inquire regarding the results of any Promotion.
7. In the event that a winner of a prize in a Competition cannot be contacted or is not available or has not claimed the applicable prize within fourteen (14) days of the Draw Date, we reserve the right to offer the applicable prize to the next eligible participant selected (in the same way as the original winner) from the correct entries that were received before the Closing Date.
8. For Instant Win Competitions, if the winner cannot be contacted or is not available or has not claimed the applicable prize within fourteen (14) days of our first attempt to contact the winner, we reserve the right to allocate a new number to the prize and add it back to the prize pool for that Competition or dispose of the prize as we see fit without any liability to the winner.

 

• Claiming Prizes

1. If you are the winner of a Competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the prize and transfer ownership of the prize to you. 
2. In the case of a cash prize, you must provide evidence that you are the sole or joint beneficiary of the bank account which details you provided. Failure to provide any of the above information might result in disqualifying your win and transferring the prize as set forth in the Promotion Rules.
3. As a winner in a Competition, you must claim your prize personally. We will not allow a third party acting on your behalf to collect the prize even if such a third party presents to us proof of such representation. 
4. If your personal details, including contact information, changes at any time you should notify us as soon as reasonably possible via email at: info@genienexus.com and include all relevant details of the Competitions you entered, your old details and your new details. If your details change within ten (10) days of the Closing Date, we will use your old details if we need to try to contact you.

 

• Prizes

1. The prize allocated for each Competition is described on the Website, however we shall not be responsible for the accuracy and correctness of the details of the prizes which are provided to our knowledge only and without liability whatsoever. In addition, we do not recommend or endorse any of the prizes offered on the Website or provide any representations with respect to any products or services offered from time to time and/or their use, their value, condition or any other aspect. All prizes are subject to availability at the time at which such prizes are to be given to the winners. We reserve the right to substitute any prize with a prize of equal or greater value. For Instant Win Competitions, there is no guarantee that all of the prizes listed on the Website will be actually won.
2. If the prize is a vehicle, we will ensure (unless stated otherwise) that it comes with a valid MOT (an annual test of vehicle safety, roadworthiness aspects and exhaust emissions) if it is required based on the specific vehicle. No taxes or insurance will be included, and it is the winners’ responsibility to insure the vehicle prior to taking it on the public roads.
3. If the prize is a holiday, an event or an activity, then the prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, tax or personal expenses or any other items not specifically stated on the Website.
4. For all other prizes, the description on the Website will provide all details of the prize, provided that we will be liable to any mistakes, inaccuracies, changes or unavailability of the prize. Please note that the prizes, as well as any other aspect of the Competitions, are also governed by our Terms of Use, including without limitations, with respect to limitations of liability and indemnification provisions set forth therein.
